What information do we collect?

 

  • We collect information from you when you register on the site, place an order, enter a contest or sweepstakes, respond to a survey or communication such as e-mail, or participate in another site feature.

How do we protect visitor information?

 

We implement a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. When you place orders or access your personal information, we offer the use of a secure server. All sensitive/credit information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated above.

 

Do we use "cookies"?

 

Yes. Cookies are small files that a site or its service provider transfers to your computer's hard drive through your Web browser (if you allow) that enables the site's or service provider's systems to recognize your browser and capture and remember certain information. For instance, we use cookies to help us remember and process the items in your shopping cart. They are also used to help us understand your preferences based on previous or current site activity, which enables us to provide you with improved services. We may contract with third-party service providers to assist us in better understanding our site visitors. We use Hotjar in order to better understand our users’ needs and to optimize this service and experience. Hotjar is a technology service that helps us better understand our users’ experience (e.g. how much time they spend on which pages, which links they choose to click, what users do and don’t like, etc.) and this enables us to build and maintain our service with user feedback. Hotjar uses cookies and other technologies to collect data on our users’ behavior and their devices. This includes a device's IP address (processed during your session and stored in a de-identified form), device screen size, device type (unique device identifiers), browser information, geographic location (country only), and the preferred language used to display our website. Hotjar stores this information on our behalf in a pseudonymized user profile. Hotjar is contractually forbidden to sell any of the data collected on our behalf. You can choose to have your computer warn you each time a cookie is being sent, or you can choose to turn off all cookies. You do this through your browser (like Netscape Navigator or Internet Explorer) settings. Each browser is a little different, so look at your browser Help menu to learn the correct way to modify your cookies. If you turn cookies off, you won't have access to many features that make your site experience more efficient and some of our services will not function properly. However, you can still place orders over the telephone by contacting customer service.

 

Do we disclose the information we collect to outside parties?

 

We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information unless we provide you with advance notice, except as described below. The term "outside parties" does not include Phastek Performance, LLC. It also does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others' rights, property, or safety.

 

However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses.

 

How can you opt-out, remove or modify information you have provided to us?

 

To modify your e-mail subscriptions, please let us know by modifying your preferences in the "My Account" section. Please note that due to email production schedules you may receive any emails already in production.

 

To delete all of your online account information from our database, sign into the "My Account" section of our site and remove your shipping addresses, billing addresses & payment information. Please note that we may maintain information about an individual sales transaction in order to service that transaction and for record keeping.

 

California Consumer Privacy Act Disclosures

This California Consumer Privacy Act disclosure ("Disclosure") supplements the Phastek Privacy Notice and is effective as of January 1, 2020. The Phastek Privacy Notice describes the personal information that we collect, the sources from which we collect it, the purposes for which we use it, the limited circumstances under which we share personal information, and with whom we share it. These additional disclosures are required by the California Consumer Privacy Act:

 

1. Categories of personal information collected. The personal information that Phastek collects, or has collected from consumers in the twelve months prior to the effective date of this Disclosure, fall into the following categories established by the California Consumer Privacy Act:

 

  • identifiers such as your name, alias, address, phone numbers, or IP address;
  • personal information, such as a credit card number;
  • commercial information, such as purchase and content streaming activity;
  • Internet or other electronic network activity information, including content interaction information, such as content downloads, streams, and playback details;
  • geolocation data, such as the location of your device or computer;
  • audio or visual information, such as voice recordings when you speak to our customer service;
  • professional information, for example data you may provide about your business if you are a Reseller; and
  • inference data, such as information about your purchase preferences.

 

2. Categories of personal information disclosed for a business purpose. The personal information that Phastek disclosed about consumers for a business purpose in the twelve months prior to the effective date of this Disclosure fall into the following categories established by the California Consumer Privacy Act:

 

  • identifiers such as your name, address, phone numbers, or IP address, for example if we use a third party carrier to deliver your order;
  • personal information, such as a credit card number, for example if we use a third party payment processor;
  • commercial information, such as the details of a product or service you purchased if a third party service provider is assisting to provide that product or service to you;
  • geolocation data, such as providing a delivery partner the location of your location in order to deliver a package;
  • audio or visual information, for example if a service provider reviews recordings of customer service phone calls for quality assurance purposes; and

 

3. Right to Request Access to or Deletion of Personal Information: You may have the right under the California Consumer Privacy Act to request information about the collection of your personal information by Phastek, or access to or deletion of your personal information. If you wish to do any of these things, please contact customer service. Depending on your data choices, certain services may be limited or unavailable.

 

4. No sale of personal information. In the twelve months prior to the effective date of this Disclosure, Phastek has not sold any personal information of consumers, as those terms are defined under the California Consumer Privacy Act.

 

5. No Discrimination. Phastek will not discriminate against any consumer for exercising their rights under the California Consumer Privacy Act.
