Certain products offered on our website are subject to environmental compliance regulations governed by the California Air Resources Board (CARB). Please review the following policies before purchasing.

1. Non-CARB Products

- Certain products offered for sale on this website are not approved by the California Air Resources Board (CARB) and are therefore not legal for sale, shipment to, or use on any pollution-controlled motor vehicle operated in the State of California.
- These products are intended for off-road or competition use only, unless explicitly stated otherwise in the product description.

2. Shipping Restrictions

- Orders containing non-CARB-approved products will not be shipped to addresses in the State of California.
- We reserve the right to cancel or modify orders with a California billing or shipping address that include such products, even if the transaction was completed online.(5% Cancelation Fee may be applied)

3. Customer Responsibility

- It is the customer’s sole responsibility to determine the legality of any product for their intended use, installation, and location.

- By placing an order, the customer acknowledges that they:
  - Understand the product(s) are not CARB-approved unless explicitly listed as such;
  - Are not purchasing on behalf of or intending to use the product on a vehicle operated within California if the product lacks CARB approval
  - Accept full responsibility for compliance with all local, state, and federal laws and regulations;
  - Release Phastek Performance from any liability resulting from the purchase, installation, or use of non-compliant products.

4. Enforcement & Fraud Prevention

- We reserve the right to monitor transactions for fraud or circumvention of state or federal emissions laws.
- Providing false shipping information, using freight forwarders to reroute prohibited items, or other attempts to bypass compliance may result in order cancellation, customer account termination, or reporting to regulatory authorities.

This policy is based on compliance with the following California regulations and statutes:

California Vehicle Code § 27156 – Prohibits the installation or sale of aftermarket parts that modify or bypass emission control systems unless exempted by CARB.
Title 13, California Code of Regulations (CCR) § 2222 – Requires CARB Executive Orders (EO) for aftermarket add-on and modified parts to be legally sold or installed on emissions-controlled vehicles.

It is the responsibility of the consumer to ensure compliance with applicable laws. Violation of these regulations may result in civil penalties or vehicle registration issues.
